Terms of Service

1. Agreement to Terms

By accessing or using Dispatch ("the Service"), operated by Kwata Team Inc. ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Dispatch is a B2B SaaS platform that helps service businesses (including but not limited to cleaning, plumbing, moving, grooming, and landscaping companies) manage operations including scheduling, dispatch, team management, client management, invoicing, and photo documentation.

Dispatch is a management platform only. We do not guarantee bookings, revenue, or client acquisition. We provide the tools; your business results depend on your own efforts.

3. Account Registration

  • You must be at least 18 years old and a legal representative of the business you register
  • You are responsible for maintaining the security of your account credentials
  • You must provide accurate and complete information
  • One account per business entity (multiple users may access through worker invitations)
  • Notify us immediately of any unauthorized account access

4. Subscription & Payment

4.1 Free Trial

New accounts receive a 14-day free trial. No credit card is required to start the trial. At the end of the trial, a valid payment method is required to continue using the Service.

4.2 Subscription Plans

Plans are billed monthly. Pricing is displayed on our pricing page and may change with 30 days' notice.

4.3 Cancellation

You may cancel at any time. Upon cancellation, your account remains active until the end of the current billing period. No refunds are issued for partial months.

4.4 Failed Payments

If payment fails, we will attempt to charge the card on file for 7 days before suspending your account. Your data is retained for 90 days after suspension.

5. Acceptable Use

You agree NOT to use Dispatch to:

  • Engage in illegal activities or violate applicable laws
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to other accounts or our systems
  • Use the platform to harass, defame, or harm others
  • Violate the privacy rights of your clients or workers
  • Resell or sublicense access to the platform without written authorization

6. Your Data & Content

You retain full ownership of all data and content you upload to Dispatch (client records, job photos, business information, etc.). By using the Service, you grant us a limited license to store and process this data solely to provide the Service to you.

You are responsible for ensuring you have the legal right to upload client data and that doing so complies with applicable privacy laws (PIPEDA, GDPR, etc.).

7. Data Security

We implement industry-standard security measures. However, no system is 100% secure. You are responsible for maintaining the security of your account and notifying us promptly of any suspected breach.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KWATA TEAM INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF DISPATCH, INCLUDING LOSS OF REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION.

Our total liability to you shall not exceed the amount paid by you to us in the 12 months preceding the claim.

9. Intellectual Property

All platform code, design, trademarks, and content belonging to Kwata Team Inc. remain our exclusive property. Nothing in these Terms grants you a license to use our intellectual property beyond what is necessary to use the Service.

10. Termination

We may terminate or suspend your account immediately, without notice, if you violate these Terms. Upon termination, your right to use the Service ceases and we may delete your data after 90 days.

11. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada, and applicable Canadian federal laws. Any disputes shall be resolved in the courts of Calgary, Alberta.

12. Changes to Terms

We may update these Terms. We will notify you by email at least 30 days before material changes take effect. Continued use of Dispatch after that date constitutes acceptance of the new Terms.
